In the criminal justice system, the competence and jurisdiction of the court is determined based on the nature, category and severity of the crime, which aims to show the facilitation or strictness of the criminal process and the execution of the sentence. In this regard, in addition to the general courts of justice, special courts are established with the aim of dealing with specific crimes or specific offenders.
This article tries to examine the prerequisites and characteristics of special security courts by explaining the necessities of establishing such a court and it seeks to answer the question of what is the necessity of establishing special security courts, and what are the characteristics of these courts, assuming that this necessity is proved?
The present study was conducted using library and documentary sources as well as the author's experiences in Intelligence affairs and its method is descriptive-analytical.
According to the results of this article, in the judicial system of the Islamic Republic of Iran, the Revolutionary Court is recognized as the only special criminal court to deal with crimes against security of state, but with a little reflection on the characteristics, nature and functions of this court, it becomes clear that this authority does not have the components of a full-fledged and effective special criminal court. Based on the experience of some other countries in the world, the establishment of a special court to deal with crimes against national security will be an undeniable necessity.
